&lt;blockquote&gt;
&lt;p&gt;A large number of Californians yesterday voted to expand the rights of chickens on the same ballot that they voted to rescind the rights of gay people.  While this may reflect poorly on human nature and its zoological priorities, it does not indicate an mortal blow to homosexual rights.  This a setback, and a temporary one at worst.&lt;/p&gt;
&lt;p&gt;The next step: bring on the lawyers — we have an Equal Protection violation here.  There’s already at least &lt;a href="http://www.mercurynews.com/breakingnews/ci_10905867"&gt;one lawsuit&lt;/a&gt;, and there will be others.  Soon enough, the case will appear before the federal courts.  Regardless of how the district court rules on the subject, it will end up before the Ninth Circuit, the most favorable venue for progressive legal issues in the country.  Gay rights have a better home field advantage in the Ninth Circuit than the Red Sox do at Fenway.&lt;/p&gt;
&lt;p&gt;What happens next will be interesting.  It is possible that the Supreme Court will refuse to hear an appeal, since the issue hasn’t been marinating in the political process all that long.  One of arguments against Roe v. Wade is that the Court weighed in before the democratic branches of government fully had their say, and before the appellate courts had all taken their sides.  If this reasoning prevails, then the Ninth Circuit will be have the last word on the subject for several years to come.&lt;/p&gt;
&lt;p&gt;Even if this proves not to be the case, and the Supreme Court upholds Prop 8, there’s still plenty of fight left.  There are three ways to amend the California Constitution: through the initiative process (California can easily get another proposition on the ballot to negate Prop 8), via a two-thirds vote of the state Legislature, or by calling a constitutional convention (something that’s long overdue as it is).  If California conservatives can game the system, then so can progressives.  And now the progressives, having been robbed of a civil right, have more motivation.&lt;/p&gt;

&lt;p&gt;I have Obama winning 314-224 over McCain.&lt;/p&gt;
&lt;p&gt;He holds all of Kerry’s states and picks up Ohio, Virginia, Colorado, New Mexico, Iowa, Nevada, and a surprise victory in Montana. Notably, I do not have him winning either Florida or Missouri because I just have a feeling that both are going to go, just barely, for McCain.&lt;/p&gt;
&lt;p&gt;Tonight could easily turn into a blowout for Obama if turnout is huge. He can potentially win Florida, Missouri, Indiana, North Carolina, and one of Nebraska’s electoral votes, putting him at a celing of 379-159. I can’t see him getting much higher than that.&lt;/p&gt;
